The exact scope of services for any client is defined separately in a proposal, agreement or invoice.

3. Client Responsibilities

Clients are responsible for providing accurate business information, timely feedback, necessary access to accounts/platforms (such as ad accounts or business listings), and approvals needed to carry out the agreed services. Delays in providing these may affect project timelines and results.

4. Payments

Payment terms (amounts, schedule and method) are agreed separately with each client before work begins. Any advertising spend paid to third-party platforms (such as Meta or Google) is separate from our service fees unless otherwise agreed in writing.

5. Campaigns & Advertising

Digital marketing results depend on multiple factors, including market conditions, competition, budget and platform algorithms, many of which are outside our control. We do not guarantee specific results, rankings, lead volumes or return on investment. Our focus is on following sound marketing practices and continuously optimizing performance based on data.

6. Intellectual Property

Any creative assets, strategies or materials we create specifically for a client as part of a paid engagement belong to that client upon full payment, unless otherwise agreed. NexGrowthDigital retains the right to showcase general, non-confidential aspects of completed work for portfolio or marketing purposes unless a client requests otherwise in writing.

7. Third-Party Platforms

Our services may involve third-party platforms such as Meta, Google, WhatsApp and others. These platforms have their own terms, policies and advertising guidelines, which clients and NexGrowthDigital must comply with. We are not responsible for changes, outages, restrictions or account actions taken by these third-party platforms.

8. Limitation of Liability

To the extent permitted by law, NexGrowthDigital is not liable for indirect, incidental or consequential damages arising from the use of our services or website, including loss of revenue, data or business opportunities. Our total liability for any claim is limited to the amount paid by the client for the specific service in question.

9. Changes to Terms

We may update these Terms from time to time to reflect changes in our services or for legal reasons. The updated Terms will be posted on this page with a revised date. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
